To Book a reservation Baja Realty Executives will need fifty percent of balanced owed as a deposit. The balance of your full payment is due 45 days prior to the commencement date of your rental period. By authorizing payment via credit card you are authorizing Baja Realty Executives to charge your credit card the balance of the total charges 45 days prior to the commencement date of your rental period. If you book your rental less than 45 days in advance of your stay, we will charge you full payment immediately and you must arrange for payment immediately or your reservation will not be accepted.
Baja Realty Executives will accept credit cards (a 3% to 5% service fee will be added for use of credit cards), cash payments made in the form of deposit to one of our American or Mexican banking accounts, Personal checks to one of our American or Mexican banking accounts, and cash if you are here in La Paz making rental arrangements.
FAILURE TO MAKE FINAL PAYMENT ON A TIMELY BASIS WILL RESULT IN THE AUTOMATIC CANCELLATION OF YOUR RESERVATION AND LOSS OF ANY DEPOSIT PAID PURSUANT TO THIS AGREEMENT’S CANCELLATION AND NO REFUND POLICY
CANCELLATION AND NO REFUND POLICY
We recognize there is a level of trust on our guest’s part in paying us in advance for our accommodation services. In return we guarantee your reservation and uphold it over any later inquiries. As many of our bookings are months in advance and cancellations often just weeks, it can often mean we can’t rebook the house which will result in a loss of payment.
We strongly recommend Travel Insurance to cover such possibilities which can also cover you for additional costs such as flight reimbursement, medical costs, lost luggage etc. We strive to avoid penalization and where a cancellation is beyond a guest’s control we do our best to offer a credit towards future accommodation depending on availability. When applicable our cancellation payment structure is:

If a confirmed rental is cancelled Sixty (60) days prior to the arrival date, we will refund one hundred (100 %) percent of the total rental money received, less the booking fee and the cancellation fee.
If a cancellation is between thirty-one (31) days and Sixty (60) days prior to arrival date, we will refund fifty (50%) percent of total rental monies received, less the booking fee and the cancellation fee.
If a confirmed rental is cancelled thirty (30) days or less prior to arrival date, or there is a payment outstanding, no refund will be given. (If the property is re-rented for the period of your rental we will refund a prorated amount depending on how many days we can re-rent it for and at what rate).
No Refund will be given for inclement weather (including hurricanes or other acts of nature) or any other matter which may inconvenience Guest’s stay at the Property but which is beyond the control of Baja Realty Executives or of Owner. For this reason, Baja Realty Executives strongly suggests that Guests purchase Travel Insurance.
We are pleased to offer the option of CSA Travel Insurance which covers trip cancellation, trip delay / interruption, rental car collision, baggage delay, medical expense / emergency medical transportation, roadside assistance, concierge service, identity theft and more. The cost is a very reasonable 7.65% of your total booking and covers everyone on your guest list. We strongly recommend you purchase this valuable protection, which will reimburse you for pre-paid, non-refundable expenses due to certain unforeseeable circumstances. However, if you do not wish to purchase travel insurance, please select “No” to Travel Insurance when booking. If you are traveling between June 1 and November 31 (Hurricane Season) or when there is a possibility of trip delay due to snow, insurance is highly recommended. A security deposit is required for all properties to cover damage to and/or loss of items from the rental, excessive cleaning (determined by our housekeepers upon your departure) I.e. excessive trash removal, excessive laundering, upholstery or carpet shampooing, and or Unpaid utility bills (phone, water, cable, electric, propane). If there are no damages, losses, excessive cleaning, and or unpaid utility bills your refund will be returned within 15 days after your departure. There are some instances where we can refund deposit money on the same day as departure. We will consider these instances on a case by case basis.
Security deposits on all long and short term rentals are equal to one month’s rent of your rental.
CONDITIONS FOR RENTAL
The individual who made the booking along with the signing responsible party at check in will here forth be referred to as the “guest”. Guest contracts will be sent via email unless requested otherwise. Phone reservations may cancel without fee within 48 hrs of the booking date if unwilling to agree to the recorded dates and Terms & Conditions of contract. Failure to notify Baja Realty Executives (BRE) of cancellation within this time period implies agreement to all policies.
Guest Responsibility: The guest acknowledges responsibility for and on behalf of all parties on the premises to the terms and conditions of rental. Failure to comply with the rules of the property and the terms and conditions of this contract by any individual on the premises associated with the renter will be the sole responsibility of the renter and be considered a material breach of this contract. The guest further agrees to be responsible and liable for the actions and safety of every person in their group.
Liability: The guest agrees to indemnify and save and hold harmless Baja Realty Executives (its officers, employees, agents and equity holders) and the Owner of the Property from any loss, liability, damage, or cost they may occur due to their presence in or upon the areas with naturally risky conditions or otherwise.
Deposits: All long term rentals will require first, last, and one month’s rent security deposit. This is for the owner’s security as they pay commission to agents at the beginning of the rental. Short term rentals require first and security deposit.
Using the security deposit is not permissible for last moths rent.
Rates: All Rates are quoted on a per month basis for no more Guests than the maximum occupancy listed. Additional Guests must be disclosed to and agreed to IN WRITING by Baja Realty Executives. Verbal confirmation by Baja Realty Executives will not be given for additional Guests.
Age Requirements: Tenant represents that he/she is twenty five (25) years of age or older. Persons under the age of twenty five may not occupy the Property unless accompanied by a parent of one of the guests during the entire stay. Any violation of this provision will result in immediate eviction from the Property.
Sub-Letting: Tenant may not assign or transfer any rights under this rental agreement or sublet any portion of the Rental Term without the express written consent of the owner or owner’s agent. Any person occupying the Property who is subletting will be subject to immediate eviction.
Rental Entry: Guest acknowledges that the rental owner and/or their agent retain the right to enter the rental for any reason, including the showing a prospective buyer the rental, by giving Guest at least 48 hours notice of such showing.
Weekly Maintenance: Some rental properties have pool cleaning and landscaping during the week. We will do our best to arrange times that will fit your schedule. However, there are some times that cannot be changed due to schedule constraints by the property management company.
Baja Realty Executives does not have the property management on all of their listed properties. One the properties where we do not have the property management business the renter will be given the owners phone number and email for any residential needs, problems, and or work that needs to be done on the rental unit. In cases where the owners are un-reachable Baja Realty Executives will do their best to resolve any issues. For rentals that are under Baja Realty Executives property management; renters will have 24 hour assistance.
Equipment Malfunction: BAJA REALTY EXECUTIVES will endeavor to address any equipment malfunction promptly on behalf of owner (such as televisions, VCRs, microwaves, etc.). Guest will not be entitled to any refund as a result of the malfunction of such equipment, however, even if a repair or replacement is not available.
Keys & Remote Controls: Lost keys will be charged at the rate of Fifty dollars ($50.00) per set to cover the cost re-keying. There will be a charge of One Hundred dollars ($100.00) for each lost remote control and garage or gate control.
Lost and Found: Baja Realty Executives and/or the property owner are not responsible for personal property left behind, stolen or damaged during your stay. Every attempt will be made to locate lost items, but there is no guarantee that they will be found. Upon check out PLEASE make sure and take all of your belongings & check the property carefully. Never leave valuables (cash, wallets, jewelry, cameras, etc.) unattended. If you find you have left something behind, call our office at 480-526-8017 and we will attempt to locate the missing item(s). There is a $25.00 Minimum Shipping Charge on all returned items. Items are held for 30 days. Items that are not picked up or shipped (at the guest’s expense), are then donated to charity.
Care and Maintenance of Property: Guest is responsible for maintaining the cleanliness of the Property during occupancy and to leave the premises reasonably neat and in good condition upon departure. This includes removing any food or drink from the refrigerator and cabinets, washing the dishes and putting them back in the cabinets, removing all trash from inside the unit and depositing same into the dumpster, and keeping the carpets and floors in a “broom-swept condition” free of excessive debris. Failure to return the premises in reasonably good condition will result in an excess cleaning fee of $200.00 or more, depending on the severity of the conditions the premises were left. Guest’s credit card on file will automatically be charged or amount will be taken from security deposit.
Water Policy: Baja California Sur has been known to have water shortages during the summer months. While all of our rentals have cisterns we ask that our summer guests regulate their water use. If water should run out it is the guest’s responsibility to pay for a truck to come fill the cistern. Baja Realty Executives and or owners are not liable for conditions such as these.
GENERAL TERMS, CONDITIONS AND DISCLOSURES
Cleaning Fee / No Daily Maid Service: A cleaning fee will be assessed for all stays, regardless of duration. This fee is to cover routine cleaning of the unit after Tenant’s departure. No cleaning or housekeeping services are provided during Tenant’s stay. Linens and bath towels are provided by owner but Tenant is responsible for washing linens and towels during the stay, as desired. The Property is equipped with a washer and dryer but not with laundry detergent. Towels and linens may not be removed from the home. The housekeeping service will supply the home with initial toilet paper, hand soap, bath soap, and kitchen trash bags prior to check-in. The home will not be supplied with paper towels, napkins, laundry detergent, dishwasher detergent or any food products. Maid service is available for a extra fee. Normally 450 pesos per clean.
Association Rules and Regulations: Tenant is obligated to observe and abide by all rules and regulations governing use of the Property, including but not limited to the provisions of this rental agreement and rules posted or published in the home, in the common areas such as the pool or designated beach area, or anywhere else on the premises of the Property.
Beach Towels/ Pool & Patio Furniture: The Property is not equipped with beach towels. Tenant may not remove bath towels, sheets, blankets, or furniture from the home and none of these items may be used in the pool area or on the beach. Tenant may not remove pool furniture from the fenced in pool area. No patio furniture may be taken from the Property to be used on the beach.
Grilling: Grilling on balconies or inside the home is NOT permitted under any circumstances. If the Property is supplied with a grill, all grilling must be done where the grill is located. Tenant is requested to keep the grill a safe distance from any combustible materials on the home. Not all homes are equipped with a grill.
Pools / Hot Tubs / Jacuzzi Tubs: The guest acknowledges if the property is equipped with a private pool / hot tub / jacuzzi tub and/or has access to a community pool / hot tub / jacuzzi tub (the“Facilities”), Renter hereby accepts and agrees to the following: A. Renter shall ensure that the Facilities are used in a safe manner at all times and that non-adult use of the Facilities is supervised by a qualified and capable adult. B. Unsafe and/or unsupervised use of the Facilities by Renter or Renter’s guests is a material breach of this contract and shall permit Baja Realty Executives to terminate IMMEDIATELY WITHOUT NOTICE Renter’s occupancy of the Property. C. Renters are prohibited to tamper with chemicals or equipment. If Renter is found to have tampered with chemicals or equipment, the Renter will be responsible for any expenses incurred. d. Renter shall indemnify and hold Seaside Vacation Homes (its officers, employees, agents and equity holders) and the Owner of the Property harmless from and against any and all liabilities, claims and expenses for personal injury or property damage resulting from unsafe and/or unsupervised use of the Facilities by Renter or Renter’s guests. Pregnant women, persons taking medication, elderly persons, those with diabetes, high blood pressure, heart disease or other cardiovascular conditions should consult their physician prior to entering a hot tub. Children under the age of 12 are prohibited from entering hot tubs at any time. Removal of chemical dispensers, misuse and/or overuse of hot tubs may result in health related problems, such as folliculitis. –Warning: Use of any hot tub carries risk that may result in serious injury or death. NO CHILDREN UNDER THE AGE OF 12 ARE PERMITTED TO USE OR INTERACT WITH THE HOT TUB AT ANY TIME. The American College of Obstetricians and Gynecologist (ACOG) state that becoming overheated in a hot tub is not recommended during pregnancy. Elderly persons and anyone subject to heart disease, diabetes, low or high blood pressure, strokes, epilepsy or similar afflictions should not enter the hot tub without consulting their physician. Never use a spa while under the influence of drugs or alcohol or if you are taking medications of any kind, or being treated for any illness. The spa should be kept at a temperature less than 104 degrees for personal safety and all bathers must shower before and after use to decrease the possibility of skin problems. DO NOT SIT OR WALK ON THE SPA COVER, or it will collapse. Supervise children at all times to decrease risk on injury, death or drowning.
Maintenance: Tenant is asked to promptly report any maintenance problems to the Property Manager. In response, the owner or owner’s representatives may enter the home during the occupancy to address the reported issues. Tenant may not leave windows or doors open while the air conditioning or heating system is operating. If doors or windows are left open on hot days while the air conditioner is operating, the coil may freeze, causing the condensing unit to shut down. This condition cannot be quickly remedied and Tenant will be without air conditioning for an extended period of time.
Maximum Number of Guests: The allowable occupancy for the Property is: one bedroom is 2 people, two bedrooms are 4 people, 3 bedrooms are 6 people. Exceptions may be made on a case-by-case basis for up to two additional persons. There will be an additional charge of $20 per person per night for guests in excess of the maximum. Any violation of this policy will result in eviction from the Property and assessment of the additional charge. This is a general rule as some properties allow more people per bedroom.
No Smoking: Smoking is NOT permitted inside the home. If any evidence of smoking is found in the home, Tenant will forfeit the entire security deposit and will be evicted. If smoking on patios, Tenant agrees to close all nearby doors and windows to prevent smoke from entering the home. Tenant also agrees to dispose of all cigarette butts in the outside trash container provided.
Minimum Age: The premises are to be occupied by the guest named on the rental agreement. Only adults (25 years old and older) may reserve and must occupy the property at all times when children are present.
Behavior/Damage/Loss: A good neighbor policy is posted at each property and is to be followed at all times. Do not permit any acts on the premises that violate any state law or rules of the management. Do not destroy damage, deface, or remove any contents or permit any person to do so. Guests are liable for all theft, damages to furnishings and damages to property during their occupancy. Guests must report any damage found at property so that BRE can track to the correct party. Guest agrees to be responsible for any cost incurred due to behavior, damage, theft and/or loss.
Good Neighbor Policy: BRE rental Homes are located in a mixed-use neighborhood that includes both short-term guests and year-round residents. We want you to enjoy your stay, but not at the expense of the neighbors so please be considerate of the neighbors with your noise and activities. Parking is limited at all homes and at most properties there is parking on the street.
Noise: No guest shall create or permit to exist any nuisance. Please respect the rights of the neighbors by restricting sound and noise to a reasonable volume. If persistent and excessive noise is a continuing issue we will terminate guest’s contract and keep the security deposit.
Doors Locked: Doors should be kept locked when the property is not occupied.
Children: Baja Realty Executives properties are not child proof nor does BRE represent them as such and thus require children to be supervised by an adult at all times. Amenities such as furniture with sharp edges, fireplaces, games with small pieces, knives, cleaning products and other examples known and unknown pose safety issues for children. Guest claims understanding, acceptance and responsibility for these risks upon booking.

Vehicles: It is understood that RV’s, boats, motor homes, trucks, motorcycles, trailers etc. are not permitted without approval. All houses have limits for the number of parking spaces. Please refer to the property listing for details.
